Regarding Council decision 2009/316/JHA 06-04-2009, Document No: 32009D0316 (still in force) Art 5, Member States are obliged to notify the Council regarding national laws in Annex A which includes perjury code offence 121200 and non-admittance as a witness in court due to violation of oath code offence 3010 Annex B. Also Member States shall notify Council regarding penalties and measures in relation to these offences, implementation date 07-04-2012. Request for access to the Department's compulsory reply record in relation to the two above mentioned offences, being offences no: 121200 and 3010 or in the alternative access to a record which shows that those offences were enacted into statutory law as per the above Council decision.
