Article 9a Member States shall ensure that the competent authority or authorities perform the duties arising from this Directive in an objective manner and do not find themselves in a situation giving rise to a conflict of interest. There is a general principle under EU law where a similar provision is implicit in relation to screening for appropriate assessment It is my understanding that on occasion the OPW is both competent authority and developer for certain projects within the scope of the EIA Directive and/or which are screened for AA since it makes the EIA and AA screening decisions. Please therefore provide a copy of the documented procedure through which your organisation implements the requirement for appropriate separation between conflicting functions in this regard. If the procedure is not documented please explain how your organisation has implemented Article 9a for sub-threshold projects and how it ensures there is no conflict of interest in AA Screening decisions.

Under the FOI Act to request: OPW manual / records related to deer management, deer culling and humane dispatch of deer Description of records: health and safety practices, checklists, animal welfare issues, carcass disposal etc as used by operatives in Phoenix Park For context: IDC trains licenced deer hunters under a LANTRA accredited programme to respond to requests by competent authorities for humane dispatch of deer IDC via Chairman, Ashley Glover requested the records via email on 29th Jan, again via meeting with Paul McDonnell, Parks Superintendent on 14th April. Mr McDonnell showed the documents in question, and ran through to confirm the scope of the records, but subsequently refused to release a copy of records to IDC (via email 17th April). Mr McDonnell instead referred IDC to a health and safety consultant (Mark Daniels in UK) to commission equivalent records. As a volunteer humane dispatch service, IDC would not be in a position to fund such an undertaking, so are requesting the records under FOI Please note this request is for the current manual / records (dated 2016). IDC understand that OPW intend to review these manuals
