Re the Bi Laratal Administrative Agreements that the EU member states signed with the EU Commission in 1998/99. Those administrative agreements followed the publication in the OJ of EU Reg 2064/97 A chara, in accord with the Freedom of Information Acts can you provide me with any documents identifying the member states that signed "Bi Lateral Administrative Agreements" with the EU Commission circa 1998/99. Those agreement were part of the Sound Efficient Management programme that the EU Commission and Dr Brian Gray introduced in 1997. Secondly, I wish to access a copy of the Bi Lateral Administrative Agreements signed in mid-1998 by the D/Finance which I am now advised comes under the authority of D/PER Thirdly, I wish to access the documented communications between the EU Commission and the D/Finance (now D/PER), which eventually led the EU authorities and Brian Gray to insist that Ireland sign those administrative agreements. I am requesting information on the approval and extension of provisions under the Employment Control Framework for the Higher Education Sector 2011 -2014 (ECF). I am making this request under the Freedom of Information Act 2014.

The ECF contains provisions 3(a) and 3(b) which severely restrict or remove the rights of retired staff of a HEI to further employment. I have been directly affected by the application of these rules in Technical University of Dublin where I was informed that I could not be considered for a post that I had applied for. The scope section of the ECF states; "This Employment Control Framework is for the period 2011 to 2014 and replaces all previous frameworks." However, the ECF is still being applied by the HEA in 2022. I am requesting the following documents; 1) Any document or electronic mail issued by the Department of Public Expenditure and Reform (DPER) to the Higher Education Authority (HEA) or Dept of Further & Higher Education, Research, Innovation & Science (DFHERIS) authorising or mandating the implementation of the measures in the ECF. 2) Any document or electronic mail issued by DPER to the HEA or DFHERIS authorising or mandating extension of the application of the ECF beyond its expiry in 2014.
